These General Conditions of Contract govern the online sale of products offered by the site eProshow
Point 65° N is a trademark distributed for Italy by Professional Show S.p.A. with registered office and operational headquarters in Via Praimbole, 15/bis in Limena (PD), P. Iva, Tax Code. E Reg. Art. 1 Completion of the contract
1.1 Orders are subject to acceptance by PROFESSIONAL SHOW S.P.A. The correct receipt of the order is confirmed by PROFESSIONAL SHOW S.P.A. by means of an e-mail reply sent to the e-mail address provided by the Customer. This confirmation message contains the order number, order date, invoice data and recipient of the goods, details and prices including VAT of the goods ordered, transport service and additional services, payment methods, PROFESSIONAL SHOW S.P.A. data, any notes and warnings to the customer. Once the order has been received from the Customer and the payment has been verified, PROFESSIONAL SHOW S.P.A. will proceed to start the phases relating to the shipment of the goods.
1.2 The offer of the products presented on the site is subject to their actual availability. In case of unavailability of one or more products, PROFESSIONAL SHOW S.P.A. will inform the Customer by telephone or e-mail of any changes to the order received.
1.3 All prices of the items proposed by the website eProshow are inclusive of VAT, expressed in euros and refer exclusively to purchases made via the Internet, net of transport costs. PROFESSIONAL SHOW S.P.A. reserves the right to modify the prices displayed at any time, with the exclusion of orders already accepted by the parties that will not be subject to price changes.
1.4 The Customer declares to have been informed that the images and descriptions relating to the products may not perfectly correspond to the actual characteristics of each individual product.
1.5 PROFESSIONAL SHOW S.P.A. assumes no responsibility for any errors, inaccuracies in the content of the website eProshow or changes by manufacturers.
Art. 2 Acceptance of the General Conditions of Sale
2.1. By sending the purchase order electronically, the Customer unconditionally accepts and undertakes to observe these General Conditions in his relations with PROFESSIONAL SHOW S.P.A., declaring that he has read and accepted all the information provided to him, also noting that the Seller does not consider itself bound by different conditions unless otherwise agreed in writing.
2.2 The General Conditions of Sale regarding the Customer as "Consumer", shall apply only to the natural person who, pursuant to art. 3 of Legislative Decree no. 206 of 8/10/2005 SS MM, "acts for purposes unrelated to the business, commercial, craft or professional activity possibly carried out". In particular, art. 5 (two-year warranty) and 6 (withdrawal) will apply only and exclusively if the customer is qualified as a consumer.
2.3 The Customer declares to have examined the General Conditions of Sale before forwarding his purchase order and undertakes and obliges, once the online purchase procedure is completed, to print or save an electronic copy and, in any case, to keep these Conditions, already viewed and accepted, pursuant to and for the purposes of Articles. 3 and 4 of Legislative Decree no. 185/99 and Legislative Decree no. 206/2005.
Art. 3 Payment
3.1 The Customer may make the payment due by:

After confirming the order and specifying the data, the customer will be diverted to the PayPal secure server that adopts the SSL (Secure Socket Layer) 168-bit protection system, currently, this system is the maximum security for the protection of information transmitted via the Internet.
By logging into your PayPal account immediately after confirming your order. By choosing the Paypal payment method you can pay directly through your Paypal account.
The bank transfer must be made to the following bank details, indicating in the reason the order number listed in the confirmation e-mail:

Upon receipt of the transfer, PROFESSIONAL SHOW S.P.A. will immediately ship the goods.
Art. 4 Delivery
4.1 Delivery costs to Italy are € 10.00 for orders of less than € 499.99 (VAT included) and free for amounts over € 499.99 (VAT included). Delivery costs to other EU countries are € 30.00 for orders of less than € 499.99 (VAT included) and free for amounts over € 499.99 (VAT included). There are no surcharges for shipments to the Islands.
4.2 Delivery is understood to be made to the number of the recipient or to the different place indicated in the transport documents (d.d.t.).
4.3 The goods will generally be delivered within 2-3 working days if the product is in stock. If in the product page, in the Availability field is indicated: "Availability: Available from stock in Europe, generally shipped in 10-12 days" the goods will be shipped in 10-12 working days. After the confirmation of payment, the approximate date of delivery will be communicated, except for the lack of responsibility of PROFESSIONAL SHOW S.p.A. for the hypothesis of delay/lack of delivery by chance or force majeure (purely by way of example accidents, explosions, fires, strikes, and/or lockouts, earthquakes, floods, heavy snowfalls and similar events) or for causes in any case attributable to the carrier.
4.4 The courier delivers without notice and in any case, as a rule, in the morning following the day of dispatch. PROFESSIONAL SHOW S.p.A. is not responsible for any delays in delivery or additional charges borne by the Customer in the event that an incomplete or incorrect address is provided. The goods travel with a regular transport document, it is considered delivered to the place indicated by the customer at the time of order confirmation unless otherwise indicated.
4.5 The goods ordered are covered by an insurance guarantee for the entire shipping phase. It is the customer's responsibility to verify, upon receipt of the goods, the number of packages and the integrity of the product. In the event that the goods at the time of verification with the courier is damaged or not intact, the customer has the right to refuse receipt of the product and / or indicate in the appropriate section of the form of the courier, the "specific reserve" describing the damage and communicating within 1 working day to PROFESSIONAL SHOW S.p.A. by e-mail to email@example.com, possibly sending photos. In the absence of a timely complaint, we will not accept claims relating to the non-integrity of the products delivered.
Art. 5 Warranty
5.1 The products purchased by the Customer who is not a consumer (i.e. in the case of purchase within the scope of his business or professional activity) are covered by the manufacturer's conventional 12-month warranty for defects of conformity and/or malfunction, not found at the time of purchase.
5.2 The products purchased by the consumer customer (i.e. in case of a purchase for purposes not related to his business or professional activity) are covered by a legal warranty of 2 years for defects of conformity and/or malfunction, not found at the time of purchase.
5.3 In the event of a lack of conformity, PROFESSIONAL SHOW S.p.A. will send the necessary spare parts to restore the conformity of the product, at no cost to the Customer. The Customer is obliged to check the goods and their functioning within 5 days from delivery. Any defects already present on the delivery of the material must be notified to PROFESSIONAL SHOW S.P.A. within 5 days of receipt of the same by e-mail to firstname.lastname@example.org, indicating the article code, details and photographs of the defect found.
5.4 In the event that PROFESSIONAL SHOW S.P.A. is unable to return a product to the Customer under warranty (repaired or replaced), the same may proceed to its consensual replacement with a product of similar or superior characteristics to the one complained of or to the refund of the amount paid taking into account the use of the goods. In the event of replacement under warranty, the Customer is obliged to send the defective product at his own expense to the Seller's headquarters:

The goods under warranty must be returned by the customer in the original package properly sealed, complete in all its parts. The customer is required to keep the original packaging and all additional documentation of the products purchased until the expiration of the warranty terms of the product.
5.5 PROFESSIONAL SHOW S.p.A. cannot be asked for any damage for any delay in carrying out repairs or replacements. If the defect reported does not result in a lack of conformity pursuant to art. 129 of Legislative Decree 206/2005, the customer will be charged the costs of verification, restoration and transport, if incurred by PROFESSIONAL SHOW S.p.A.
5.6 PROFESSIONAL SHOW S.p.A. shall not be held liable in the event of improper use of the products.
The warranty does not cover components subject to wear, such as hooks, rigid shells, harnesses, rails.
Art. 6 Right of withdrawal of the Customer Consumer
6.1 The Consumer Customer has the right to withdraw from the contract without penalty and without specifying the reason within 14 (fourteen) days of receipt of the goods by registered letter with return receipt to be sent to the headquarters of the company PROFESSIONAL SHOW S.p.A. at the following address: PROFESSIONAL SHOW S.p.A. Via Praimbole, 15/bis - 35010 Limena (PD) - ITALY
declaring to want to exercise the right of withdrawal and indicating the order number, invoice number, code and quantity of items, if the withdrawal is partial (only in the case of purchase of more than one item) or total.
6.2 PROFESSIONAL SHOW S.p.A. will refund the price within a maximum of 14 (fourteen) days from the day of receipt of the Consumer's notice. In any case, PROFESSIONAL SHOW S.p.A. shall be entitled to withhold the refund until the date of receipt of the goods or demonstration by the Consumer of having returned them.
6.3 The consumer is responsible for the direct costs of returning the goods. The shipment for the return of the material, until confirmation of receipt in our warehouse, is under the full responsibility of the customer. PROFESSIONAL SHOW S.p.A. is not liable in any way for damage or theft/loss of goods returned by shipments not insured by the customer.
6.4 The right of withdrawal is excluded in the following cases:
a) lack of original packaging;
b) absence of integral elements of the product (e.g. manuals, accessories and in general different conditions in which they were delivered);
c) damage to the product (e.g. products that are not substantially intact, used or that show defects, deterioration, signs of wear and / or alterations of any kind)
d) purchase of customized products according to the indications requested by the Customer.
6.5 The non-consumer customer does NOT have the right of withdrawal.
Art. 7 Applicable law and jurisdiction
7.1 This contract is governed by Italian law.
7.2 Except in the case of a contract concluded with a Consumer, for all disputes that may arise from the application or interpretation of this contract, the Court of Padua shall have exclusive jurisdiction.
7.3 The European Commission has set up an online platform that provides a tool for non-judicial resolution of any dispute relating to and / or arising from contracts for the sale of goods and services concluded online. Consequently, if you are a European consumer, you can use this platform for the resolution of any dispute arising from the online contract stipulated with the Owner.
